FORECLOSURE NOTICE gpn11 WALLACE NOTICE OF SALE UNDER POWER, HABERSHAM COUNTY Pursuant to the Power of Sale contained in a Security Deed given by Jodi A. Wallace to Branch Banking and Trust Company dated 9/1/2005 and recorded in Deed Book 721 Page 642, HABERSHAM County, Georgia records; as last transferred to or acquired by BB&T, conveying the after-described property to secure a Note in the original principal amount of $ 29,400.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of HABERSHAM County, Georgia, within the legal hours of sale on August 05, 2014 (being the first Tuesday of said month unless said date falls on a Federal Holiday), the following described property: ALL THAT TRACT OR PARCEL OF LAND lying and being in Land Lot 33 of the 10th Land District of Habersham County, Georgia, designated as Lot 18 of the Soque Trail Subdivision, containing 1.57 acres, more or less, as shown on a plat of survey prepared by Russell N. Bartlett, R.S. under date of December 4, 1984, a copy of said plat being of record in the Office of the Clerk of Superior Court of Habersham County, Georgia, in Plat Book 21, Folio 77, to which said plat and the record thereof reference is hereby made for a more complete description. ALSO CONVEYED: A right of way of ingress and egress over and across Cross CreekTrail, Soque Ridge Trail, Raintree Court, and all those roadways and easements as shown by Phase I Plat of Soque Trail dated June 12, 1984, recorded in Plat Book 20, Folio 104, as well as any and all other roadways providing access to the public road adjacent the overall property from which this parcel was taken. NOTE: The above described property is conveyed subject to Protective Covenants imposed by an instrument dated August 15, 1984, recorded in the Office of the Clerk of Superior Court of Habersham County, Georgia, in Deed Book 198, Page 422; amended by an instrument dated April 11, 1985, recorded in said office in Deed Book 204, Page 698; amended by an instrument dated July 16, 1985, recorded in said office in Deed Book 206, Page 733. This is the same property conveyed to Joseph O. Yarbrough and Beth Yarbrough from Joseph O. Yarbrough via Warranty Deed with Right of Survivorship dated November 1, 2002 and recorded on November 7, 2002 in Deed Book 570, Page 341 of the aforewritten deed records.The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property is commonly known as 301 Crosscreek Trail, Demorest, GA 30535 together with all fixtures and personal property attached to and constituting a part of said property, if any. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
